1. Definition
Unless inconsistent with the context, in these terms:
"Agreement" means the application form and these terms.
"Booking" means the booking form enclosed.
"Booking cost" means the total booking cost specified on the booking form.
"Booking period" means the period commencing when the Client arrives at the premises and ends when the Client leaves the premises.
"Premises" means any hotels, conference centres, venues we see fit to use.
"Client" means the company, firm or individual specified on the booking form.
“User” means the company, firm or individual browsing the fear of flying website for personal and non personal use
“Fear of Flying” means the individuals involved in the design and implementation of the fear of flying course
"Programme" means Fear of Flying programme as described in the booking form.
“Product” means physical items for sale on the fear of flying website
"Terms" means these terms and conditions.

Users may download, view and print content from this site for private and non-commercial purposes only.
3. Disclaimer
3.1 The client acknowledges that apart from the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act, neither Fear of Flying nor any of its agents or representatives shall be held liable for any damage, loss or liability of any nature, arising from the use of this website and services provided by it.
3.2 Fear of Flying makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this web site are free from errors or omissions or that the service will be 100% uninterrupted and error free. Users are encouraged to report any possible malfunctions and errors by using the ‘Contact Us’ contact form on this website.
3.3 This web site is supplied on an "as is" basis and has not been compiled or supplied to meet the user's individual requirements. It is the sole responsibility of the user to satisfy itself prior to entering into this agreement with Fear of Flying that the service available from and through this web site will meet the user's individual requirements.
3.4 All items purchased from Fear of Flying are made pursuant to agreements with shipping and delivery agents and risk of loss pass from Fear of Flying to such agents upon delivery of any item to such carrier.
4. The services
The Fear of Flying course will be made available to the client for the booking period in consideration of the full booking cost being paid.
5. Prices
The price of each course/product is displayed with the product. In the event of a sale or special offer, the discounted price is displayed.
6. Payment
The client shall pay the booking cost in full before the programme is made available to the client.
7. Payment Method
7.1 Credit card payments
At the time of placing the order, the transaction details are presented to the bank and an authorization is obtained for the amount of the order.
7.2 Electronic Funds Transfer/Internet Payment
If the buyer selects the 'EFT' option, instructions will be given on how to transfer monies. The exact amount must be paid and the payment reference must be the order number which is received upon completion of the ordering process. Note that:
· No bank deposits are accepted from outside the borders of South Africa.
· Unpaid orders will be cancelled within 5 days from date of order.
7.3 EFT/Internet Payments
Where EFT/Internet Bank Transfers are selected as the payment option, payments may be made to the banking details which will be made available upon confirmation of booking and purchase
8. Security
8.1 Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Fear of Flying suffers any damage or loss.
8.2 The user agrees and warrants that its log-in name and password shall:
* be used for personal use only; and
* not be disclosed to any third party.
8.3 The user warrants Fear of Flying to take all reasonable steps to ensure the integrity and security of the Fear of Flying site is maintained at all times.
8.4 All credit card transactions are Secure Socket Layers encrypted.
9. Changes to this Policy
Fear of Flying may, in its sole discretion, change this agreement or any part thereof at any time without prior written notice

11. Email Address
11.1 Clients and users understand and agree that Fear of Flying may from time-to-time send the clients and users promotional material, product updates and new product notifications. Removal from this distribution list will be available
11.2 Clients and users will receive updates on your product/course via e-mail.
12. Contact Information
During the registration process as a clients you will be prompted to enter: Title, Name, Address & Telephone Numbers. This information is considered confidential and is not accessible by the general public.
13. Cookies
"Cookies" are used to identify a clients and users computer when they visit Fear of Flying website. They are used to remember returning clients and users and as a result make it easier for browsing the website as a returning user and client. “Cookies” contain no personal or proprietary information.
14. Shipping & Returns
14.1 Shipping
All orders over ZAR 1,500.00 will be shipped free of charge. Orders under ZAR 1,500.00 the cost of shipping within the borders of South Africa is added to your cart automatically.
Please use the ‘Contact Us’ form to enquire about international shipments.
14.2 Delivery Times
14.2.1 Express Delivery: Delivery Time 24 Hours, provided order is received and paid for before 12h00 Weekdays (SA Post Office Speed Services, Counter to Counter)
14.2.2 Standard Delivery: Delivery Time 4 Days, (SA Post Office Speed Services, Counter to Counter)
14.2.3 All items purchased from Fear of Flying are made pursuant to agreements with shipping and delivery agents and risk of loss pass from Fear of Flying to such agents upon delivery of any item to such carrier.
15. Cancellation and refund Policy for booked programmes
15.1 Cancellation made by the client will only be valid if made in writing
15.2 Cancellation made by the client 30 days or more before the commencement of the booked programme will be refunded 100% of the booking cost
15.3 Cancellation made by the client between 14 and 30 days before the commencement of the booked programme will be refunded 50% of the booking course
15.4 Cancellation made by the client 14 days or less before the commencement if the booked programme will not be refunded at all, and fear of flying will retain 100% of the booking cost
15.5 The sums stipulated in clauses 15.3 and 15.4 above represent liquidated damages to compensate feat of flying for all losses incurred as a result of such cancellation and the parties acknowledge that they comprise reasonable pre-estimates of actual loss
15.6 For the purpose of clause 15.2, 15.3, and 15.4 above only, the expression “days” shall include Saturday, Sunday, and any other Public holidays
15.7 All refunds will be paid to the client and/or user in cash, EFT, or directly into the client’s credit card.
16. Refund policy for purchased products
16.1 In the case of purchased products on the fear of flying website, a refund will only be given in the following situations:
* proof of non-delivery
* wrong delivery of a specified order.
16.2 In the case of purchased products on the fear of flying website, the following are non-returnable and non-refundable examples:
* Errors in user-selected options;
* Damage to the products arising after delivery to the customer;
16.3 All refunds will be paid to the client and/or user in cash, EFT, or directly into the client’s credit card.
17. Fear of Flying obligations
Fear of flying only obligation shall be to provide the programme on a date to be agreed with the client. If a programme is cancelled or postponed by Fear of flying, then Fear of Flying shall use its reasonable endeavours to offer the programme on an alternative date or shall make a full refund of the booking cost to the client.
18. No guarantee
Fear of Flying shall use its reasonable endeavours to help the client to overcome a fear of flying by use of the programme but in no way guarantees the success of the programme and no refund of the booking cost shall be made if the client believes that the programme has not been successful.
19. Behaviour
Fear of flying reserves the right, in its absolute discretion, to ask any client to leave the programme premises. Fear of Flying decision to remove any such person shall be
final and Fear of flying and its employees shall not (notwithstanding anything contained in this agreement) compensate any person in any way in respect of such removal. The
client hereby undertakes to comply with all lawful instructions of Fear of flying through the booking period.
